What is a court bond (caución judicial) in Colombia?
It's the guarantee a judge may require in a lawsuit, for example to order or lift precautionary measures. It secures costs or damages, depending on the case, and the General Code of Procedure (CGP, art. 603) allows an insurer to provide it.
How much is a court bond?
It depends on the amount to be guaranteed, set by the judge, the law or the bid terms, plus the term, the type of bond and your profile. We quote for free with Seguros del Estado, Mundial, Solidaria, Bolívar and others.
How do I get a court bond?
Send us the court order requiring the bond, with the amount and term, and your details. If the insurer approves it, it issues the policy and you file it with the court, which decides whether to accept it (CGP, art. 604).
What does a bid bond cover?
It covers the penalty if, for example, you withdraw your offer after the deadline or, if you win, you don't sign the contract or deliver the performance guarantee. In government contracts, it must generally cover at least 10% of the offer (Decreto 1082 de 2015).
Can a missing bid bond be fixed later?
In government contracting, no: not submitting it with your bid can't be corrected and is grounds for rejection (Ley 1150 de 2007, art. 5, par. 3, added by Ley 1882 de 2018). So get it in good time; we help you.
